European Chemical Agency (ECHA) publishes First REACH Authorisation List - February 2011

The first authorization list naming six substances under the REACH Regulation (EC No. 1907/2006) was published by the European Commission on February 17, 2011.  These six substances were taken from the REACH Candidate List to which substances of very high concern (SVHC) are nominated for inclusion to the Authorisation List. 

Regardless of tonnage, these six select SVHC whether on its own, in a mixture or incorporated in an article, can no longer be placed on the market after the specified sunset date unless the following conditions are met:

• Authorisation has been granted
• There is an exemption from authorisation (for ex. intermediates)
• The authorisation application was made prior the "latest application date".

Manufacturers, importers and downstream users located in the EU are required to apply for authorization in order to use or sell the above substances.  Final goods manufactured in the EU which incorporate any of the substances are therefore subject to authorisation while imported articles are not. 

Still for Non-EU based components suppliers, it is expected that questions regards REACH compliance will still apply as compatibility issues may arise.  

Downstream users in the EU are urged to check with their suppliers to determine if they require authorization or if the suppliers have already obtained it.  The authorization list is expected to grow as the European Commission continues transitioning chemicals from the Candidate List.
