Bisphenol A (BPA) Regulatory Update - March 2011
The concern over Bisphenol A (BPA) continues to trend up. Thus far BPA regulations have been introduced on a state level, with a number of key states enacting legislation to limit BPA in food and beverage containers for children 3 years of age and under, as well as certain consumer products designed for food contact and reuse.
The city/states currently regulating BPA include Chicago, Connecticut, Maine, Maryland, Minnesota, New York, Vermont, Washington DC, Washington and Wisconsin.
No federal ban is yet in place though Bill S 136 also known as the “Ban Poisonous Additives Act of 2011” has now been introduced in Congress. S 136 will address children’s food for children three yrs of age and under, and infant formula where the container is composed of BPA. It will also regulate empty baby bottles or cups that contain BPA retailed for children three yrs of age and under.
In addition a number of states have pending regulations for BPA which if approved have proposed effective dates slated for the end of 2011 and early 2012. The states currently reviewing BPA regulations for enactment are Alaska, Arkansas, California, Iowa, Kentucky, Maryland (addressing additional consumer products), New York (addressing additional products such as toys and child care articles), Oregon, Pennsylvania, Tennessee and Texas.
Most of these pending regulations focus on children’s food and beverage containers, although a few have included regulations covering children’s toys, child articles, cosmetics, jewelry and metal food cans lined with BPA.
